Agreement to terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Creative Life Design,  ("Creative Life Design Retreat", “we”, “us”, or “our”), concerning your access to and use of the http://www.TheCreativeLifeDesign.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site. 

CREATIVE LIFE DESIGN RETREATS

Retreat Payment Policy

A non-refundable, non-transferable $2000 sum is required to secure your booking for the Creative Life Design Retreat, the "Booking Fee".

Due to the exclusivity and limited availability, deposits are non refundable. There will be no deposit refunds provided in any circumstances at any time. Upon booking, your credit card will be charged for the Booking Fee, held on file, and charged for the remaining amount due on May 15, 2024. If you would like to change the payment method for the final amount due or pay in full prior to May 15, 2024, please contact the Dana@TheCreativeLifeDesign.com to make alternate arrangements. Any alternate payment arrangements are at the sole discretion of host.

Foreign conversion fees and transaction fees may be applied by your bank and are outside of our control. We are not responsible or liable for any additional fees or charges.

To be able to participate in Creative Life Design Retreat you must have a valid passport and be able to travel to our destination independently. Flights are not included. Payments must be made in full by May 15, 2024 and will be automatically charged to the credit card on file unless prior arrangements have been made and agreed to by hosts. Bookings made after May 15, 2024 must be paid in full at time of booking. Failure to complete payment by the due date will result in loss of entry to Creative Life Design Retreat, no refunds will be given.

We highly recommend travel insurance and personal health coverage for all clients. This must be bought independently as it is not included in the retreat price. It is your responsibility to read and understand our cancellation policy before making a reservation. 

Kindly note that we do not furnish itemized invoices, as our pricing structure is based on comprehensive package rates. It is important to recognize that insurance companies may not extend full coverage to our packaged services. The potential for coverage on individual components is contingent upon your chosen service providers; however, we are unable to provide any guarantee regarding the extent of such coverage. This matter rests solely within the jurisdiction of your individual insurance policy and the pertinent insurance company. Please be advised that our organization cannot assume liability in the event of reimbursement denial by your insurance provider, in any way, and refunds will not be given under these circumstances.

By agreeing to these terms and conditions you are stating that:

• You have authorized to use the Debit/Credit card and/or PayPal account, to have your payment details stored on file, and to be automatically charged the remaining amount due on May 15, 2024.
• You will not charge back, dispute, reverse any payments. 
• We reserve the right to ban any account/person without notice for any reason. 
• You have read the Terms & Conditions and agree. 
• You agree to be bound to the Terms and Conditions and everything listed above and below. No refunds will be granted.

Cancellations made by the Guest

All payments are final and non-refundable for any reason.

Once you cancel there will be NO window to reschedule, rebook, or to transfer. And no refunds will be given for any deposit or payment made for any reason. 

All retreat payments are due 90-days prior to the start date of the booked retreat. Clients whose balances are not received by the 90-day deadline, risk forfeiting their retreat booking. 

Cancellations made by Creative Life Design Retreats

We reserve the right to cancel or postpone a retreat at our sole discretion. If we cancel or postpone a retreat, we will use reasonable efforts to reschedule to a future date. 

Retreat venue, dates and locations are subject to change without prior notice. Creative Life Design Retreat reserves the right to change any and all vendors and make changes to the retreat schedule or event without notice. 

Creative Life Design Retreat is not responsible for any incidental expenses or consequential losses that the Client may have incurred as a result of the booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, loss of enjoyment, and anything outside the scope and direct control of Creative Life Design. If the Client is offered a refund but requests an alternate retreat of a higher value than that originally booked, then the Client must pay the difference in price.

Arrival and Departure

Late Check-Ins and Early Check-out: If you arrive late or leave early, (FOR ANY REASON) there will be no credits and no refunds. Any unused components of the retreat cannot be transferred.

Late Check-Outs Policy: late check-outs are at the sole discretion of Creative Life Design Retreats and fees may be incurred.

Early Check-in Policy: Early arrivals prior to the check-in time stated in the policy of the villa or resort where Creative Life Design Retreat is located will not be accommodated.

No-Show and Late Policy: If you are absent or arrive late to any scheduled event, experience, or service during the Creative Life Design Retreat for any reason, a non-negotiable fee may be added at the discretion of the host.

Additional Services: 

You are fully responsible for any additional services that are not included in the scheduled itinerary. If you would like to schedule additional coaching, mindfulness, or wellbeing sessions outside of the allotted work hours shown on your itinerary, additional fees may be added at the discretion of the host. 

Excursions, services, events, tours, and anything you choose to engage in outside of the Creatively Life Design Retreat scheduled itinerary are optional. If you choose to participate in anything outside of the retreat itinerary, you assume full responsibility and enter into an agreement with the individual operator that is separate and distinct from Creative Life Design Retreats. We assume no responsibility or liability with any such arrangements.

Flights and Transfers

Flights must be booked independently and are the sole responsibility of the Guest. Please ensure your flight dates and times allow you to participate in the full itinerary of the retreat. If you have any questions about the itinerary or airport transfers, please contact the host.

Transfers to and from the airport outside the scheduled group transfer times are available at an additional cost. Scheduled transfer times will be published closer to the event date.

Guests are also welcome to arrange their own method of transport such as a taxi.  Please note, however, that taxi costs are generally charged per person and may vary, and you will enter into an agreement with the individual operator that is separate and distinct from Creative Life Design Retreats. We assume no responsibility or liability for any such arrangements.

Room Damages

If you damage your room or any of the property within the villa, we will automatically deduct the cost of repairing / replacing / redecorating from your registered card on file.

Comments and Complaints

If you feel unwell or are not happy with the retreat for any reason, please tell your Retreat hosts immediately. We will take reasonable steps to address the situation at our sole discretion.

Room Share

If you would like to share a room with someone you know, please contact us directly to enquire about the room rate and availability. Please note that we have a maximum capacity that we can accommodate on site.  

Compliance with rules and regulations

Guests are required to abide by any rules and regulations established by the retreat organizers and staff.

General Waiver

You acknowledge that during the Creative Life Design Retreat you participate voluntarily in any and all activities arranged, and insofar as is legally permissible, you surrender your right to any cause of action against Creative Life Design Retreats, their agents, contractor’s, employee’s and directors, arising from any loss or damage to any person or property that occurs during a Creative Life Design Retreat up to and including death.

If you are currently pregnant, or under medical or psychiatric supervision, you must provide a Doctor’s certificate confirming your fitness to travel and take part in the retreat as well as notifying Creative Life Design Retreats. Creative Life Design Retreat is unfortunately not suitable for those with psychiatric or deep emotional issues or those looking for counseling or therapy, as our team are not professionally qualified in these areas. Our team is also not medically trained and do not know your medical history so cannot offer any specific medical advice whilst at the retreat.

All health issues including allergies MUST be disclosed at the time of booking.

Clients are responsible for their own health, well-being, and personal safety during and after the retreat.

It is advised that the client communicates any specific dietary requirements at the time of booking or as soon as possible thereafter. We will endeavor to accommodate, but cannot guarantee completely allergy-free meals or accommodations for any other specific requests. For accommodations that are possible, additional fees may apply at the discretion of the host.

Creative Life Design Retreats and its staff shall not be held accountable, liable, or responsible for any illness, injury, or death that may occur during or after their attendance. This includes, but is not limited to, accidents, medical conditions, allergic reactions, or any other incidents.

Our retreat is not suitable for children under the age of 18 years or for people with physical disabilities that cannot take care or responsibility for themselves as we do not have the resources or expertise. There are areas of the retreat that people with mobility issues may not be able to access. 

Your Health and Wellbeing

Many health benefits are associated with regular exercise. However a small number of people should not participate in certain activities and should seek medical advice. In case of any doubt please consult a doctor before commencing physical activity offered at the retreat.

No Warranties Given

We make no representation, guarantee, or warranty that the coaching workshop sessions that you are contracting for will work for you in your particular circumstances.  You agree to hold the Retreat harmless and indemnify it for any damages incurred by you directly or indirectly as a result of the workshop sessions.

Exclusions

All information provided on the website and any written and verbal form of correspondence is correct at the time of publication.  However, due to mechanical faults, weather conditions, or what insurers call ‘Acts of God’, some amenities, activities, excursions, and other planned itinerary inclusions may be temporarily unavailable. Very occasionally, we may have to vary the advertised programme due to staff sickness or other unforeseen problems, in which case we will always try to provide an equivalent replacement. This may not always be possible. For example, if the weather is poor on the day of our scheduled boat outing, it is likely that it will be too short notice to reschedule this for another day. This is extremely rare, but could happen. The same applies to any of the activities. Clearly we will always do our level best to make sure all activities go ahead if possible. 

Team Members and Classes:

In the event of one of the team members becoming injured, ill or any emergency situation that forces them to leave the retreat, then this may impact the retreat plan in terms of the yoga or fitness classes or talks being canceled. We will do whatever we can to adapt to the situation and reduce the impact this may have on your retreat experience, however we may not be able to engage a substitute team member. The retreat will continue to run however things will be adjusted to reflect the team situation. There will be no refunds or compensation to reflect any such changes.

Creative Life Design Retreats will not accept liability for:

• Any of the above events, or others beyond our control.
• Loss, injury, or damage (to you) or your personal property.
• Physical, medical or psychiatric conditions developing during or after your retreat.

We encourage you to ensure that your travel and/or health insurance policy covers these and other contingencies.

Indemnity

You agree to fully indemnify without limitation any trainer(s), director(s) or contractor(s) against any injury, malpractice, mishap, or accident during any and all interactions with the Company away from, or at the primary place of business for Creative Life Design Retreats.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

Assumption of Risk

By agreeing to these terms and conditions, I/we state that I/we wish to participate in the Creative Life Design Retreats and all the activities, which could include but are not limited to: aerobic & resistance exercise, yoga, pilates, tai chi, running, walks, swimming,  (pool and sea), use of gym equipment, kayaking, sailing, and paddle-boarding. I/we realize that my/our participation involves the risk of injury and even the possibility of death. Furthermore, I/we confirm that I/we are voluntarily engaging in an acceptable level of exercise and Creative Life Design Retreats are not responsible for any injuries or losses incurred whilst at the retreat, after the retreat or during the transfer.

If I/we suffer with any health conditions including but not limited to the following, I/we confirm that I/we have either consulted with a doctor before participating in physical activity or I/we accept full responsibility for my/our own health and I/we acknowledge the risk involved.

Bone or joint or back problem/pain; high or low blood pressure; surgery or recent injury; Diabetes or any other metabolic disease; raised cholesterol; heart condition; cancer; pain in your chest when you do physical exercise; unusual shortness of breath at rest or with mild exertion; pregnant; spells of severe dizziness or have lost consciousness; Epilepsy; angina.

Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of The United Kingdom, The United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

Photo / Video Release – Use of Image

You hereby grant to Creative Life Design Retreats the absolute and irrevocable right, and unrestricted permissions to use photographic portraits/images/videos in which you feature that are taken during the retreat to use/republish/copyright, etc. for commercial use in association with Creative Life Design Retreats. You hereby release and discharge Creative Life Design Retreats from any and all claims and demands arising out of or in connection with the use of the photographs and video footage, including without limitation any and all claims for libel or invasion of privacy.

Privacy Policy

We care about data privacy and security. By using the Site, you agree to be bound by our Privacy Policy posted on the Site, which is incorporated into these Terms of Use. Please be advised the Site is hosted in the United States. If you access the Site from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in the United States, then through your continued use of the Site, you are transferring your data to the United States, and you agree to have your data transferred to and processed in the United States. 

Term and Termination

These Terms of Use shall remain in full force and effect while you use the Site. If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.  

We cannot guarantee the Site will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site during any downtime or discontinuance of the Site. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or to supply any corrections, updates, or releases in connection therewith.

Corrections

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

Electronic Communications, Transactions, and Signatures

Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE SITE. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

Miscellaneous

These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Use or use of the Site. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.

Creative Life Design Retreats is a smoke free retreat (including e-cigarettes and vaping). Anyone found smoking in the property may be asked to leave the retreat and no refund shall be given. No recreational drugs may be brought to the retreat, any guests found intoxicated or under the influence of recreational drugs will be asked to leave the retreat (no refund shall be given).

This contract is entered into under the laws of the Turks and Caicos and in agreeing to these terms and conditions you are doing so on behalf of yourself and any other parties included in your booking.

By booking any retreat with Us you agree to be bound by and adhere to all policies and rules.
